Please read the following terms and conditions carefully before entering into a contract with Send My Mail. By making financial payment for this service agreement, you are accepting the terms and conditions of this contract.
In these terms and conditions, “we” “us” and “our” refers to Send My Mail. Your access to and use of all information on this website including the purchase of our services is provided subject to the following terms and conditions.
We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.

Members
In order to access the services provided on this website, you must become a member. You must complete registration by providing certain information as set out on our membership/registration page. Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide on registration.
You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
On registration, we provide you with a password and user ID. On registration you agree to pay for our services as set out on our website.
We reserve the right to terminate your membership at any time if you breach these terms and conditions.

Our Services
Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.
All prices are in Australian Dollars (AUD) and are exclusive of GST. We endeavour to ensure that our price list is current. Our price list can be accessed from our home page and we reserve the right to amend our prices at any time. If you have placed an order for our services, we undertake to fulfil your order at the price listed at the time you ordered.

This website may from time to time contain hyperlinks to other websites. Such links are provided for convenience only and we take no responsibility for the content and maintenance of or privacy compliance by any linked website. Any hyperlink on our website to another website does not imply our endorsement, support, or sponsorship of the operator of that website nor of the information and/or products which they provide.
You may link our website without our consent. Any such linking will be entirely your responsibility and at your expense. By linking, you must not alter any of our website’s contents including any intellectual property notices and you must not frame or reformat any of our pages, files, images, text or other materials.

Disclaimers
From time to time we may host third party content on our website such as advertisements and endorsements belonging to other traders. Responsibility for the content of such material rests with the owners of that material and we are not responsible for any errors or omissions in such material.
Limitation of Liability
To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the services again or payment of the costs of having those services supplied again.
We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services we have supplied.

Indemnity
You indemnify and hold Send My Mail harmless from and against any and all claims, liabilities, proceedings/or causes of action, demands, actions, and all damages, costs or expenses (including legal expenses) relating to or arising from the provision of the services by Send My Mail.
Send My Mail will not be held liable for any loss, damage or delay arising out of, or be in default of its obligations by reason or the inability to perform its obligations under this contract for any reason that is beyond its control including but not limited to power failure, strikes, labour disputes, war, shortage of materials or transportation, government regulation, fire, flood, storm or Acts of God.
The services and use of Send My Mail are without warranty of any kind, including, without particular purpose. In no event will either party be liable for indirect, special, incidental, or consequential damages, loss of profits, loss of use or data, or interruption of business arising in any way out of this agreement, whether such alleged damages are labelled in tort, contract, or indemnity, even if such party has been advised of the possibility of such damages.

General
Send My Mail is a mail redirection service offered to the traveller. Send My Mail maintains the right to refuse delivery/forwarding of any illegal, dangerous, stolen, damaged or hazardous material /mail and may cancel the contract, at our discretion, with no refund applicable. At all times, it is the responsibility of personnel entering this agreement, to ensure that mail of this type is not forwarded/re-directed to Send My Mail. You authorise Send My Mail to open your mail for the purpose of scanning it and placing it in a password protected e-mail attachment or to forward it to an address selected by you. It is your responsibility to advise Send My Mail of any mail you specifically do not want Send My Mail to open. You can do this by completing the “Option” section in the registration/application form which we have provided on the last page of this contract. You can update this form at anytime during the contract however you must do so in writing.

Security
Send My Mail will ensure that electronic copies of your mail stored on their computer system is adequately protected. Send My Mail cannot guarantee that all data being stored or sent will not be subject to access by unauthorised third parties. Send My Mail accepts no responsibility for mail that is accessed by unauthorised third parties.
Selections of mail to be scanned
It is your responsibility to choose which mail is to be scanned or forwarded. You may at anytime advise Send My Mail of alterations or amendments to your original selections of mail to be scanned/forwarded. This must be done by e-mail and include your code number/password provided by Send My Mail. A minimum of 10 working days notice is required for changes to be implemented.

Payment
Payment is required in full at the time of registration. Once payment has been confirmed you will be sent an e-mail containing a registration number and a confirmed password. This payment will be made up of the number of months for which the service is required, multiplied by the applicable monthly fee. Send My Mail will begin charging our monthly fees on the commencement date specified on the registration form or upon the arrival of your first piece of mail at our office, which ever occurs first. Monthly fees are based on 31 days from the commencement date.

If you wish to extend the contractual period of service you can do so at anytime by simply advising us of the extension required and paying us the applicable fees. Once payment has been received, the new contractual end date will be updated.

Money Back Guarantee for Mail Scanning Service
If you are not satisfied with the quality of the service received in respect of your mail scanning service, you may cancel your service with Send My Mail within 7 days of commencement and we will refund you the services fees (“Money Back Guarantee”).
Excluded from the Money Back Guarantee are:
Setup fees;
Administration fees.

The Money Back Guarantee is limited to one claim per customer and only applies to new customers without existing accounts.
Customers who have amounts owing under any of their other accounts are not eligible for the Money Back Guarantee.
Forwarding of Mail To You
A total weight of 500 grams of mail (which has not been scanned) will be forwarded to you once per month, without charge, despatched on the last business day of each month. Mail being forwarded weighing in excess of 500 grams will be sent by Australia Post. The cost will be calculated, and included in an e-mail to you. Once you have made the payment to Send My Mail, the mail will be despatched to the address of your choice. These costs will vary each time depending on the location, amount of mail and how quickly you require the mail. A $2 handling fee is charged by Send My Mail each time mail is sent in excess of 500 grams (not for each item). Mail lost in transit is not the responsibility of Send My Mail, however Send My Mail will endeavor to locate the lost items through Australia Post.
Mail which has been scanned, will be stored at Send My Mail until you request the mail to be forwarded to you, or request it to be recycled. Until such time Send My Mail will continue to store your mail. Subject to the cancellation of this contract.
You can advise Send My Mail where to send your mail via Phone, fax, or e-mail. Details must include your password and registration number. Contact details are available on the contact page of the Website – www.SendMyMail.com.au
Forwarding of Your Mail to Send My Mail
It is your responsibility to arrange to have all mail forwarded to Send My Mail. Send My Mail takes no responsibility for mail that does not arrive at its office. Once mail is received at Send My Mail, it will be receipted, scanned and stored. The address where your mail is to be redirected to will be e-mailed to you, along with your user ID and password after your registration application has been processed.
Send My Mail will only accept two (2) applicant names per agreement. Multiple couples traveling together who have different originating addresses are to sign up on separate applications. No mail will be opened unless it is in the name of the applicants.
Scanning
Send My Mail will scan both printed sides of each item of mail. Blank pages will not be scanned. Only the first page, or cover, of a magazine, brochure, flyer, any marketing material, or books, will be scanned and e-mailed to you. You will receive these items in the e-mail attachment and may choose to have the document forwarded to you by courier, Australia Post, or similar service. We will not scan magazines, publications or copyrighted documents.
Each month you are entitled to 50 pages (single) of scanned mail, included in your monthly fee. All single pages after this are charged at 50c per page.
Mail will not be recycled unless written instructions from you, are forwarded to Send My Mail instructing us to do so, or when you have not requested the stored mail to be forwarded and a period of 30 days after contract end date occurs.
Privacy
Send My Mail respects your privacy. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner. Indemnity

Law and Jurisdiction
These terms and conditions are to be governed by and construed in accordance with the laws of Queensland and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Queensland and you agree to submit to the jurisdiction of those Courts.
If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Cancellation
At the end of your contract, all mail being stored will be returned to an address nominated by you. If you do not provide Send My Mail with an address, Send My Mail will send the mail back to the address listed on this contract. The cost for the delivery is to be paid by you prior to the mail being despatched by Send My Mail. The cost will be calculated, and included in an e-mail to you. Once you have made the payment to Send My Mail, the mail will be despatched to the nominated address. If payment is not made within 30 days of contract end, all mail being stored may be recycled.
You may cancel this service at anytime however you must do so in writing and give Send My Mail 30 days notice of your intention to do so. Send My Mail will not refund paid money, for unused months of service.
The terms and instructions on how and where mail is to be forwarded, are detailed on the website and form part of this contract.

Miscellaneous
The Customer grants to Send My Mail a license to reproduce all Customer Data in order to fulfill its obligations under this agreement. In this agreement “Customer Data” means all information, data, text, logos and images and/or content in any form that forms part of the Customer’s usual mail which is required to be converted to e-mails.
A provision of, or a right created under this agreement, may not be waived except in writing signed by the party granting the waiver, or varied except in writing signed by the parties.
The law in force in Queensland governs this agreement and the transactions contemplated by this agreement.
You may not resell Services provided by Send My Mail or assign your rights and obligations under this agreement without our prior written consent.
